GARDEN CITY, Idaho (CBS2) — Property owners in the Plantation golf course neighborhood are suing to stop a controversial townhome project planned for development on part of the golf course. Plaintiffs in the case are moving forward after a recent district court ruling.

Residents in the Plantation golf course neighborhood are suing out-of-state developers and the LB River Club Owner to stop a townhome development that would eat into 10 acres of golf course. The plaintiff argues that the development would breach the original Plantation master plan, which they say was intended to keep the golf course in perpetuity.

The defendants filed a motion with the district court to dismiss this case, something homeowners and plaintiffs say is part of an ongoing ploy to stall legal proceedings while they try to push approval for the development through the Garden City Council and planning and zoning. A public hearing over the development with the Garden City Planning and Zoning Commission is scheduled for Tuesday, July 8, at 6:30 p.m.

The district court ruled against the defendants and denied their motion to dismiss the case, opening the door to discovery and a legal determination.
