Personally, I feel once I've decided to stop looking for a ball and play another, the first ball no longer belongs to me. If someone finds it and chooses to give it back to me it becomes mine again, but if they want to keep it they have every right. I have abandoned the ball at that point and someone else picking it is just cleaning up the course.
If someone said "Hey, that's my ball" I would give it back and apologize. Plenty more balls out there that are well and truly abandoned, no reason to start something.
Not sure but in England I think lost balls become the property of the golf club. Could be wrong – I usually am.
Imo once you have left the hole and stopped looking for it, It's fair game.
Legally it never ceases to be the property of the original owner, so If they identify it as thiers and ask for it back failure to do so its, legally, theft. Technically you should make 'reasonable efforts' to return it to its owner. However playing a ball you find is not an offence in itself but under the letter of the law they should be handed in to the course.
