Bannon the former White House advisor this is the attorney charged with defending them both or task with defending them both and he is going to war for the university in the state of Tennessee well some of the attorneys on the NCAA side are Tennessee law alums so that’s going on uh in East

There too this is a huge story uh it is going to be fascinating to see how it plays out of course part of the investigation involving the uh NCAA the recruit of Niko malava the University of Tennessee being kind of on the Forefront with one of these I don’t want to call
Them Mega nil deals but it’s it’s kind of setting the stage for what people are looking at as the standard when Matt rule references how much the cost of a college quarterback is in terms of dollars and cents now where you have to account for these things in name image and likeness
Allocation um basically the University of Tennessee and this $8 million nil deal for Nico and how it is that he got it and what is what were the circumstances around it at the time and what is it within the guidelines of the ncaa’s guidelines at the time versus what the guidelines are
Now how much those things have changed over the course of I mean when did they first start recruiting Nico I mean nil has been into effect for two years now two three years two and a half I I mean that but that’s not what the point of the preliminary injunction hearing is
About like kind of reminding people of why the University of Tennessee is under investigation why the state of Tennessee and the state of Virginia are pushing back against the NCAA why Josh hpel has thrown uh his input into the mix because this is a situation where they’re trying
To set the stage for the future of nil moving forward and the NCAA is pushing back now this injunction if GR would allow us the kind of chaos that we were rooting for early on and how they kind of reformulate it’s a little more Controlled Chaos I guess the ncaa’s argument is
That if this injunction is granted and their nil rules do freeze until the case concludes then it’ll throw the college football world into chaos like it’s not already in that state sure but that would be different I mean you you fully acknowledge that the level of chaos that
That would bring about where there just are no rules for this thing would be a different level of extreme now maybe all of this stuff is happening under the surface anyway it’s just kind of like paying players prior to nil right we all know this stuff is happening it’s not acknowledged in the
Light of day that’s how I see now it’s a legalized version of it and so maybe this is just all right full-blown Commerce let’s go just going to be out on the table shouldn’t it be that way anyway cuz that’s what hen like we find out all
The details of like Nico’s actual money if this Junction gets granted the details of that over the course of the last couple of years all the financials of it in ways that they’re not being reported on now you don’t know actually what the financials of the name image
And likeness deals are under the current construct it has been reported that Nico is somewhere in the ballpark of $8 million in his agreement with uh through Spire Sports in the University of Tennessee and part of that not being the reason that he went to the University of
Tennessee but as a product of him going to the university of Tennessee is the is the University’s argument and of course they’ve also issued a response the NCAA they’ve been you know fighting this thing tooth and nail and it just kind of seems after the first after the TR the
Temporary restraining order and the initial injunction wasn’t granted it was looked at as okay the NCAA kind of just got by this one for now but there is a plan here and now we kind of see or we’ll start to see why people from the University of Tennessee now state
Legislators including the Attorney General of the state of Tennessee and Governor Bill Lee and everybody’s being so hyper-aggressive about this it’s because they clearly have a plan as to how they’re going to approach this and put Tennessee Virginia and basically the future of nil on the table
To be defined more concretely by the universities who are tasked with implementing it the court stated after the trro was not granted that you know while you can’t show a reparable harm therefore the trro not granted the plaintiff seems likely to win in this case like the courts don’t see the NCAA
As having a terribly strong case that they are not in violation of the Sherman Act so it’s going to be an interesting process we’ll see how long this takes but that would be the first big this is the first big battle like the trro was a little mini Skirmish before the two
Actually met a dust up call it exactly exactly this is the first significant ruling in this case where you’re talking about significant implications of rules being frozen and who knows if that would lead the NCAA to kind of cut their losses and drop everything against Tennessee and say all
Right clearly this is not going in our Direction uh no I don’t think they can afford to put down the knife in this in this situation because now that seems to be what a lot of the reporting of it believes would happen that if the injunction was granted that the NCAA
Would kind of have to back off I just I think that they are in such a survival mode and listen they don’t deserve as an institution to survive I’m not advocating on behalf of the NCAA here I think the NCAA is rotten to the core the way that it’s governed
Collegiate Athletics uh in a way that has basically used unpaid labor and the worst kind of unpaid labor unpaid I mean I guess they’re 18 so they’re technically adults but I understand you understand what I’m saying unpaid College labor as the the foundation for a multi-billion dollar industry that
They’ve run a muck up they’ve been the Mafia the NCAA Mafia basically until the last couple of years and so it’s such the the reason that I I would think at least my initial reaction and we’ll of course have Dan lust on regularly to talk about this to
Walk us through the legal ease but did you see that uh marshia Blackburn and the uh the senator from New Jersey the Democratic senator senator from New Jersey Cory Booker the only time you’re going to see those two names in a sentence together working together they reintroduced the NCAA accountability act
After the NCAA launched the investigation investigation into Tennessee and Tennessee and Virginia responded with the uh with the the Anti-Trust lawsuit so now it’s opening them up to a different level of scrutiny at every level just because two of the states in this Union are taking them to
Court and laying them out well I’m looking forward to having someone that was actually there to day at the hearing in Tyler wetstone at 11:45 so he can tell us more about the interaction that’s being reported on between the judge and the NCAA attorney attorney with the question to distinguish between
Recruits negotiating nil offers which is not allowed by the NCAA and recruits quote engaging in conversations with collectives about nil values which is allowed by the NCAA that’s the way Adam Sparks puts it out there if that sounds confusing it’s because it is and apparently the NCAA
Attorney had a tough time trying to draw that line which makes a lot of sense so I’m looking forward to hearing Tyler wetstone walk us through that part of the hearing he’s probably scared he’s thinking about because again it’s it’s the Ripple effects of this are
Nationwide I mean it is it has the potential to legitimately change to be the biggest force of change in what we currently know the governance of Collegiate Athletics to be cuz now you’re talking about do the doj could find them up to $15 million if they’re found in violation of
This antitrust lawsuit based on on what Blackburn and Booker are putting out there uh a couple of years ago this has been out there it’s why spy Sports was going to Congress a couple of years ago and we talked about how funny it would be for federal oversight to be on on on
College athletics instead of the NCAA like trading one for a worst version of the other is going to improve things but I uh it’s a fascinating case you know I I want to say lucky for us that it’s happening at least partly in the state of Tennessee primarily in the state of
Tennessee because I think that you guys have a vested interest in how it is that this program in particular Tennessee football restores itself to the place that it can within the context of the new landscape right this is a huge deal for the for the Tennessee football team for the
Tennessee athletic department but theot team is the primary driving factor and the fact that they have been on the Forefront of this which means that they’re the first ones or or one of the first ones to deal with these kind of hurdles I just think that uh I just
Think that there’s going to be a lot of stuff that comes out through this that has the ability to just be body blow after body blow to the NCAA in ways that we really haven’t seen until you know the the the the Supreme Court ruling was a
Massive blow to the NCAA like that is the driving force behind all of this now we’re in the part we’re in the part of uh the part of it where you’ve seen The Simpsons right stop it stop it he’s already dead now now we’re just going to
See how long Tennessee and Virginia and anybody else that wants to jump in wants to take turns hitting the NCAA with a baseball bat it definitely does not feel like the Dark Cloud hanging over the program that maybe the prid investigation did because that was a case of Tennessee
Admitting they were wrong you know for reasons that benefited Tennessee but cooperating with the NCAA and ultimately awaiting a judgment to be handed down that was a very this is out of our control type of thing we’re just going to cooperate get out of paying this
Buyout and see if that helps us down the road this feels different this doesn’t feel like it’s and it’s going to be used against Tennessee I’m sure but it doesn’t feel like just that cloud hanging over the program when Tennessee not just Tennessee the state of Tennessee not this the university are
Fighting tooth and nail I know I keep defaulting to the University of tene and it’s literally the state the Attorney General of Tennessee so it it it it’s got a different feel to it for sure than the last last investigation that we went through which
Was not long ago because you you got him shook it’s because you got him shook I I think I think one of the biggest missteps and again I would like to one of the biggest public missteps from the NCAA was the response you know getting out there and saying we don’t really
Comment on these situations but in this particular case we’ll we’ll get out there and comment because it just leaves you open to more more arrows from things like Danny White right who gets out there takes a winning position well you’re leaking it to the media like Tennessee hasn’t leaked stuff to the
Media Danny White knows this it’s just an easy thing for you to to get a crack at the pinata next that’s what the NCAA is at this point I don’t know what kind of candy they got in there we’ll figure it out the invite list for the 2024 NFL

In the eastern part of the state Jonathan scr’s prepared remarks say quote it’s a wonderful day to fight on behalf of our student athletes in Tennessee they are the backbone of college sport Sports due to the ncaa’s arbitrary and illegal rules student athletes are being harmed and prevented from making important decisions
Concerning their name image and likeness rights which may have a big impact on their academic and financial Futures meanwhile everybody else involved in college sports is getting rich at those student athletes expense that is not legal not right and it needs to change antitrust law in this area is clear and
As the court has previously said our case is likely to succeed on on the merits we are happy with the case’s progression and look forward to litigating it fully if necessary exciting did you see that a Tennessee fan rented a crane sure did to hang a big Power te Banner outside of the
Gous I mean the NCAA wants to fight they’re going to get a fight I mean there had to be like PS like Brent hubs was on Ramone Kayla and will saying like don’t go to the courthouse like that will not help Tennessee have a bunch of hollering
Tennessee fans just out yeah I mean it’s a public it’s a public courthouse so every citizen has a right to go but they had to kind of put out some PSAs of like hey don’t let’s not go sing Rocky Top in the courthouse on at 9:00 a.m. on a on a
Tuesday this is what I’m saying I feel like the NCAA has picked the wrong fan base to make an example out of you know like and maybe it’s just the timing again Tennessee with this this Nico deal there was always going to be inquiring minds from the NCAA involved around a

McCarthy who Harbaugh says he wouldn’t be surprised if he went as the first quarterback in this club no toia tongoa the big 10’s all-time leading passer who tried to stay in college and appeal did you did did we talk about that we really didn’t but I
Did see the story where he was trying to appeal to he was one of these Co eligibility quarterbacks he had been bouncing around it a while he’s been at Maryland uh for a period of time now had been statistically good so what what was the remind me why he was interested in
Returning well he wanted to stay in college despite having exhausted his eligibility but the basis of his appeal was when he burned his red shirt at Alabama you know he can play four games and preserve the red shirt he played in five in the oh I don’t want to misspeak
Maybe 2019 season the season were Tua got hurt at Mississippi State the reason he played his fifth game and burned that red shirt was because in that moment and I don’t know if you remember that Tua injury when he’s getting carded off the field the hip he’s got a bloody nose
Like looks like been in a car accident and the sort of emotion of that moment Tulia wanted to go in for his brother and he went in barely played a few snaps in that game against Mississippi State because he had just watched his brother get carded off the

Texas always puts a bunch of people in but they don’t have it broken down by school here it’s just it’s just the full list alphabetically I’d be surprised if there is a school with more than Georgia with 11 if there is maybe Michigan is there but not Alabama I think a lot of

Not in dispute by anybody media analyst otherwise and since then you know his the difference between his performances at home versus on the road for South Carolina are really really bizarre there’s you know there’s something to that that I think you want to learn more about I think that his demeanor is
Something that coaches are going to have to they’re going to have to talk to him before they realize oh cuz he he gives off a little bit of I don’t know how would you describe Spencer Rattler personality Levis had Levis had a little bit of this with him you know and maybe
It’s because we’re in Tennessee and vs fans hated him at Kentucky and and this that and the other and and he was pretty comfortable talking about some stuff will Levis betzer Rattler is also he’s a he’s a solid quote and that’s not always a coach’s favorite thing but he kind of
Gives off a little bit of bleep you personality right so I think he’s going to he’s one that coaches are going to have to get to know get these inperson meetings with him um and and kind of understand more of the makeup of the human being and how that affects his his
Football performance because the football performance is also in question but there’s clearly Talent there Joe Milton had a rough Senior Bowl as far as the actual game oh the accuracy was so bad yeah a couple of turnovers one interception that got returned 83 yards but combine feels like it sets up really
Nicely for Joe yeah that that one though I Joe Milton I think you take it on a case-by Case basis and I think Joe Milton the Senior Bowl is he has to do better you you have to prove to them that you can play quarterback outside of the system that they’re already suspect
Of and Milton can play quarterback well enough within Tennessee’s offensive system there were some things that were left to be desired it obviously wasn’t as efficient all all the things we talked about throughout the course of the year with Joe Milton as the starting quarterback but you remember you remember the discourse around
Tennessee’s offense last year with henden hooker who was I mean the face of college football for basically the entire season until he tour his ACL with the two receivers tman and and hayatt how how we how curious we were about how much they would be dinged almost for
That Beyond you know their deficiencies as wide receivers or quarterback or whatever and injury was a factor with henden injury obviously a factor with henden hooker but none of them went before the third round and with Tillman and hayatt you looked at and and hayatt obviously has
Some some different quirks he’s not a complete receiver Cedric Tilman is probably the more prototypical player and we’ll see how that develops in Cleveland over the course of his career but not I I don’t think there is enough you know there’s enough proof of concept of those players we’ll find out what
Henden hooker does if anything in in Detroit at some point obviously he’ll be healthy coming into the season he’ll have an opportunity to back up golf it probably the the expectation he’ll be the backup I would think so Teddy Bridgewater’s coach in high school ball oh is that what he’s doing in retirement
He’s coaching his Alma moer down in Florida that’s cool good for Teddy but we continue to check every box with Joe Milton outside of consistency in terms of accuracy and processing as a quarterback did you see this from the Senior Bowl Jim naggie tweeted that the annual good guy award that was created
Uh to honor a lost member of the senior bull family I don’t want to mispronounce his last name Brian ingerrand uh but Jim naggie tweeting that they created that award in honor of him and Joe Milton is the recipient of the first annual good guy Award presented to the player that according
To naggie is just a great guy behind the scenes well we know that right right that’s we continue to know that we continue these are the things that are known about Joe Milton the football part of Joe Milton is the thing that I very very much have question marks but I mean
He’ll be you you remember how Ramone like Ramone got kind of passionate about when he called in from the Senior Bowl where we made the joke about well how many oysters has he thrown this and stuff like that and Ramone kind of got into it a little bit which I
Liked about the idea of he needs to be more than a sideshow he’s he’s athletically not like Anthony Richardson athletically Sideshow but he’s a bit of a sideshow he’s a bit of a novelty and that’s not what you want he has to be a quarterback
Well which is why and I I say that and I don’t love saying this but which is why I say the combine seems so perfect for Joe Milton what is the combine other than a sideshow on athleticism how far you can throw a football measurables height size weight speed
Interviews like Joe Milton is a guy who comes across great in a room he’s going to blow away people in interviews he’s going to be a genuine guy he’s charismatic and he’s going to have all the athletic traits he’s going to launch the football at 90 yards at the combine
And everybody’s going to oo and a at Lucas oal Stadium I mean I understand how important the NFL scouting combine is but well here’s it’s more Sideshow than it is actual football no I agree and and so that will help him here’s here’s the difference between what we’re
Talking about right Joe Milton will come out of the combine favorably I’m pretty comfortable saying that provided that you know he’s healthy and all these things but coming out of the combine favorably just becomes a talking point for a period of time the people who are tasked with evaluating are going to know
And differentiate okay we’ll you know we can’t wait to see him throw it as pro day two and I’m sure he’ll look great with guys that he knows that he’s throwing to because there’ll be dudes out there working out with him and stuff like that well maybe we’ll see I don’t I
Know if we’ll see guys like Brew McCoy or whatever but we’ll we’ll probably see some Tennessee uh players go out there and catch passes for him the value of the combine the reason that the combine exists first and foremost is the Medicals because everybody it’s just so much easier to
Get everybody into one spot to medically evaluate as many of these prospects as humanly possible with as many of the team doctors team medical personnel uh comine NF league medical personnel and all these different things the reason for combine primarily is the Medicals and the drills on top of that that have
Become you know more positional uh positionally specific but you still kind of understand that there’s there is some value to it it is not the full picture so yeah combine’s going to be combine’s going to be a big week for Joe what did you just whisper in my ear

To the judge to to make his ruling of the injunction um he has obviously as much time as he wants to to make that whether that’s later this week or next week or whenever that that may be um but the state Tennessee came out today pretty persuasively um saying that
You know this this injunction is needed because nil isn’t just about uh monetary damage whenever an athlete’s making his decisions and what could happen and what what the inity is uh kind of ring on anyway so uh yeah a lot to a lot to discuss and happy to distill whatever
You uh whatever you like so with that I guess as we when you were going on or or getting to cover this case and familiarizing uh yourself with this case what were the biggest questions that you had going in yeah I think the the question being I
Don’t think the Judge is concerned about what an injunction or what destroying nil in general I I don’t think he really cares about that I don’t think really the state of Tennessee cares about that beyond what it does or doesn’t do to athletes within Tennessee uh whatever
That means to NCAA going forward is the ncaa’s business and how they figure that out so I think just mostly interested in what is the state of Tennessee going to argue this is not just a a sports case certainly not just a University of Tennessee case impacts student athletes
All over Tennessee and Virginia um so how will they how will they make this argument where it makes it look like it’s not just University of Tennessee Coming Out Swinging after being uh allegedly getting some more allegations of wrongdoing so I think they’ve done that pretty well to this extent but
We’ll see Tyler a lot of the reporters were coming out and tweeting on social media whatever it might be about the interaction between judge and NCAA attorney where he’s asked to actually draw that line between having discussions about nil value and actually negotiating nil contracts as that maybe
Being a stumbling point for the NCAA did you see it as that yeah absolutely um and I mean to give the to their credit it is complicated and I think what Tennessee attorney general schdy was saying afterwards is listen if if the attorney for the in blate are confused
On this because it’s it’s complicated and it’s just it’s messy how can you expect high school athletes to understand what is and isn’t the case and what they can and can’t do so um yeah it they definitely uh the judge picked up on that pretty quickly and

Error of Collegiate Athletics before there is too much of that irreparable harm done because I do believe that there will be instances of this instances of this when the Supreme Court ruling passed you you saw immediately where players families uh especially athletes who may not come from the the
Best means or the the best situations could be exploited in this way and I I just I I like that this feels more preemptive than reactionary to a lot of the damage that could potentially be done by this yeah and that’s the state’s argument obviously um again it’ll be up to the
